The Temporary employment agency industry includes businesses that provide employees to companies on a temporary basis. This type of employment is also known as travail interimaire or temping. Temporary agencies are required to have a registered office in France and must provide their client companies with a register of their employees. The duration of each worker’s contract must not exceed 12 months. Temporary employment agencies must prove that they have financial collateral in the form of a surety bond or an insurance undertaking or bank established in France or in the European Union or in the European Economic Area and authorised to grant bonds and operate on French territory (Article R. 1263-1). This guarantee must cover the payment of all wages and wage supplements owed to interim employees posted on French territory, including the end-of-assignment allowance and compensatory allowances for paid leave, and must include the name of the guarantor company and its address.

During the posting period, the company must appoint a representative present on French soil who will act as a liaison with Labour Inspectorate inspectors, but also with the judicial police, tax and customs authorities and social security bodies. The representative must also be responsible for storing and providing to the Labour Inspectorate the documents that are required to be kept at the disposal of inspectors.
